Common problem

Many Vietnamese businesses invest heavily in product design, packaging, and styling, but fail to register industrial designs in time. As a result, their ideas are copied, and counterfeit goods proliferate without legal basis for action.

Loss of legal ownership

Industrial designs are only protected when a valid certificate from a state agency is obtained. Without registration, businesses have no legal right to prevent others from using or copying them.

Being copied and registered by competitors.

Competitors can copy the design and register it first. In that case, the company that created the design would be considered to be infringing if they continued to use it.

It is not possible to request action against the violation.

Without a patent, businesses cannot request authorities to take action against infringing acts, even if they suffer serious losses in revenue or reputation.

Difficulties in transferring ownership or raising capital.

Unprotected designs cannot be legally valued or transferred, hindering fundraising, collaboration, or the sale of licensing rights to third parties.

Legal risks when releasing a product.

If a design is publicly disclosed before registration, the business loses its protection because it does not meet the "novel and unique" condition under the law.

A product can be copied in just a few weeks, but patent protection can help you safeguard that design for 5–15 years.

Check for protection eligibility

Check for protection eligibility

Before registering an industrial design, the most important step is to determine whether the design qualifies for protection .
Inter Justice will help you assess the novelty, inventiveness, and industrial applicability of the product through:

  • Analyze design drawings, models, or images;

  • Preliminary search based on the databases of the Vietnam Intellectual Property Office and international databases (WIPO, ASEAN IP);

  • Compare it to previously published designs to determine its uniqueness.

👉 Result: You know exactly whether your design is eligible for protection or needs further adjustments, avoiding unnecessary time and registration costs.
